The Accused (released in theaters on October 14, 1988) stands as a groundbreaking, searing courtroom drama that confronted systemic victim-blaming and fundamentally shifted how cinema approaches justice for survivors of sexual assault. Directed by Jonathan Kaplan, the harrowing story begins when Sarah Tobias (Jodie Foster), a working-class woman, is brutally gang-raped by three men in the back room of a local bar while a crowd of patrons cheers and encourages the attackers.

Asst. District Attorney Katheryn Murphy (Kelly McGillis) takes the case but, fearing Sarah’s uninhibited lifestyle and past drug use will alienate a conservative jury, cuts a plea bargain behind Sarah’s back.

The assailants are allowed to plead guilty to lesser charges of reckless endangerment, serving minimal jail time without ever being labeled as rapists on their records.

Devastated and outraged by a legal system that treats her as if she were on trial, Sarah confronts Katheryn, demanding true accountability.

Realizing the profound injustice of her compromise, Katheryn devises an unprecedented legal strategy: she indicts the onlookers who egged on the assault, charging them with criminal solicitation.

The landmark prosecution hinges on identifying witnesses willing to step forward, leading Katheryn to Ken Joyce (Bernie Coulson), a conflicted college student who witnessed the crime.

Supported by key testimony and facing fierce opposition from defense attorneys, Katheryn brings the case before a jury.

The trial exposes the terrifying mob mentality of the bystanders, ultimately securing a guilty verdict that validates Sarah’s humanity and sets a historic precedent for legal responsibility.

Steve Antin, Leo Rossi, Carmen Argenziano and Tom O’Brien round out the supporting cast.
